These Terms and Conditions (“Terms”) govern your use of the UMEED DESIGNS website (the “Site”) and all purchases made from UMEED DESIGNS (“we,” “us,” “our,” or the “Company”). By accessing our Site, placing an order, or otherwise engaging with our services, you agree to be bound by these Terms and our Privacy Policy.

1. GENERAL INFORMATION
UMEED DESIGNS is a Canadian modest wear brand operating both online and through in-person channels. Our products are offered subject to their availability and our acceptance of your order.

2. ORDER ACCEPTANCE AND CANCELLATION
Order Acceptance: All orders are subject to acceptance by us. The receipt of your order confirmation does not constitute our acceptance of your order. We reserve the right to refuse or cancel any order for any reason at any time, at our sole discretion, before or after acceptance, without liability to you.
Reasons for Refusal/Cancellation: We may, in our sole discretion, limit or cancel quantities purchased per person, per household, or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers, or distributors.
Notification: In the event that we cancel or make a change to your order, we will attempt to notify you by contacting the email address, billing address, or phone number provided at the time the order was made.

3. ACCURACY OF ACCOUNT AND BILLING INFORMATION
You agree to provide current, complete, and accurate purchase and account information for all purchases made on our Site. You agree to promptly update your account and other information, including your email address, credit card numbers, and expiration dates, so that we can complete your transactions and contact you as needed.

4. SALES TERMS, DUTIES, AND TAXES
Shipping and Customs Declarations: All shipments will be accurately declared with the full value of the contents for customs purposes. We will not under-declare values or mark shipments as “gifts” on any customs forms. This is strictly prohibited.
Delivery Duty Unpaid (DDU): All international sales (outside of Canada) are made on a Delivery Duty Unpaid (DDU) basis. This means:
The price you pay covers the cost of the item(s) and shipping to your destination country.
It does NOT include any import duties, taxes (such as VAT, GST, or HST), customs clearance fees, or brokerage fees levied by the destination country.
The customer is solely responsible for paying all such fees and charges upon arrival of the shipment in their country. We have no control over these charges and cannot predict what they may be. Please contact your local customs office for more information.
Sales Tax within Canada: For orders shipped within Canada, applicable federal and provincial sales taxes (GST/HST/PST) will be added to your order total at checkout and remitted by us.

5. RETURN AND REFUND POLICY

Contact Us First: If you are not happy with your order or have any concern, we encourage you to reach out to us directly at info@umeeddesigns.com (or any provided modes of contact mentioned on our “contact us” page).We are committed to customer satisfaction and will work with you to find a resolution. All returns, without exception, must be pre-authorized by us via email.

Condition of Returns: To be eligible for a refund or exchange, items must be returned in their original, unworn, unwashed, and unaltered condition, with all original tags attached and in the original packaging. We reserve the right to refuse a refund or exchange if the item is returned in a condition that is different from how it was originally shipped.

Return Shipping: If an online purchase is returned to us via mail and a refund is declined due to its condition, and the item must be shipped back to the customer, it will be done so at the customer’s expense.

In-Person Returns: In-person returns are subject to the same rules and principles as online returns, including the requirement for pre-authorization and inspection of the item’s condition.Returns will only be accepted in person during a pre-arranged, agreed-upon time, which will be confirmed in a correspondence email. We will not accept unannounced in-person returns.Under no circumstances should returns be left at our doorstep, studio, or any other unattended location. We do not accept responsibility for any returns that are dropped off without prior authorization and a confirmed appointment. Any items left unattended will be considered abandoned property and will not be processed for a refund or exchange.

6. INTELLECTUAL PROPERTY AND PROHIBITED USES
Brand Misrepresentation and Re-selling: The UMEED DESIGNS name, logos, designs, and all product designs are the intellectual property of the Company. Misrepresentation of our brand or the unauthorized re-selling of our products for commercial purposes is strictly prohibited.
Prohibited Uses: In addition to other prohibitions, you are prohibited from using the Site or its content:
For any unlawful purpose.
To infringe upon or violate our intellectual property rights or the intellectual property rights of others.
To harass, abuse, insult, harm, defame, slander, disparage, or intimidate based on gender, sexual orientation, religion, ethnicity, race, age, national origin, or disability.
To submit false or misleading information.
To upload or transmit viruses or any other type of malicious code.
For any obscene or immoral purpose.
To interfere with the security features of the Service.
We reserve the right to terminate your use of the Service for violating any of the prohibited uses.

Our liability shall be limited to the maximum extent permitted by law in the Province of Ontario and under Canadian federal law.

These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein.
